Introduction

Welcome to Jhomar Hauling, LLC ("Jhomar Hauling," "we," "us," or "our"). These Terms and Conditions govern your use of our hauling services. By engaging with our services, you agree to comply with and be bound by these Terms. Please read these Terms carefully before using our services. Jhomar Hauling is a professional hauling company located in Cliffside Park, New Jersey, specializing in hauling and removal services. We offer a wide range of services tailored to both residential and commercial clients, including but not limited to:


Junk removal and disposal, Construction debris hauling, Furniture removal, Yard waste hauling, Household and office cleanouts, Appliance removal, Dumpster rental services, Storm debris removal, Hazardous waste disposal (when applicable and compliant with regulations)

3. Service Agreement

Before any hauling services are performed, we will provide an estimate or quote based on the scope of the work. 4. Payment Terms

A deposit may be required for large or scheduled hauling jobs.The balance will be due upon completion of the service, unless otherwise specified.If there are additional charges (e.g., for extra weight, time, or unforeseen circumstances), these will be communicated before the service is concluded.


All invoices will be sent to the Client, and payments must be made promptly to avoid any service delays or disruptions.


5. Changes to Scope of Work

If there are any changes to the scope of work during the hauling service, such as additional items to be hauled or special requests, these changes will need to be agreed upon by both parties. We will provide an updated estimate for any added work. Additional charges may apply if the scope of the hauling service increases.


6. Scheduling and Cancellations

Services will be scheduled based on mutual availability. The Client is responsible for ensuring that the area to be cleared is accessible and ready for hauling at the scheduled time.


Cancellations: If the Client needs to cancel or reschedule a service, we require at least 24 hours' notice. Cancellations made with less than 24 hours’ notice may incur a cancellation fee. No Show or Delayed Access: If the Client is unavailable or the site is not accessible at the scheduled time, we reserve the right to charge a fee or reschedule the service with an additional fee.


7. Site Access and Preparation

The Client agrees to provide clear access to the area from which items will be hauled. This includes ensuring that pathways, driveways, or any areas to be accessed are free from obstruction, hazardous materials, or debris. The Client is responsible for ensuring that no items are hazardous, toxic, or illegal to haul.


8. Types of Items We Will Haul

Jhomar Hauling will accept a wide range of materials, including, but not limited to:


General household junk (furniture, appliances, etc.)Construction debris (wood, drywall, etc.)Yard waste (branches, leaves, grass, etc.)Office equipment and furnitureElectronics and scrap metalRenovation and demolition debris


However, we will not haul

: Hazardous materials (chemicals, asbestos, paint, etc.) Biological or medical waste, Anything that violates local, state, or federal laws, Anything that could pose a safety hazard to our team or the environment


The Client is responsible for ensuring that no prohibited materials are included in the hauling request.


9. Warranties and Guarantees

Jhomar Hauling provides our services with the highest level of care and professionalism. However, we do not provide warranties or guarantees regarding the condition of the area after the hauling is completed, especially when the site may have pre-existing damage. Our guarantee is for the safe and efficient removal and disposal of agreed-upon items.


10. Liability and Insurance

Jhomar Hauling maintains appropriate insurance coverage to protect both the company and the Client during the hauling process. Our insurance covers:


General liability, Property damage, Workers' compensation


However, we will not be held liable for any damages to property or injuries caused by improper access to or preparation of the site. Additionally, Jhomar Hauling is not responsible for damage to landscaping, pavements, or structures that may occur during hauling.


11. Termination of Agreement

Either party may terminate the Service Agreement by providing written notice. In the event of termination, the Client will be responsible for payment for any services already rendered, including any materials hauled or any preparatory work done. If the hauling service is canceled or terminated by the Client after the service has commenced, a termination fee may be charged based on the work completed.


12. Dispute Resolution

If any dispute arises between the Client and Jhomar Hauling, both parties agree to attempt to resolve the issue through informal negotiation. If resolution cannot be achieved, both parties agree to enter into mediation before pursuing further legal action. The mediation process will be conducted in accordance with local New Jersey laws.


13. Privacy and Confidentiality

We respect your privacy. All information provided by the Client will be treated with strict confidentiality and used solely for the purpose of performing the hauling services. We will not share or sell your personal information to third parties, except when required by law or as necessary for the fulfillment of services.


14. Indemnification

The Client agrees to indemnify and hold Jhomar Hauling harmless from any and all claims, damages, liabilities, and expenses arising from their use of our hauling services, including but not limited to claims arising from prohibited items, illegal disposal, or damages caused by improper access to the site.


15. Governing Law

These Terms and Conditions are governed by the laws of the State of New Jersey. Any disputes arising under or related to these Terms shall be resolved in the appropriate courts located in Bergen County, New Jersey.


16. Modifications to Terms

Jhomar Hauling reserves the right to amend or modify these Terms at any time. Any changes will be communicated to the Client in writing. By continuing to use our services after such modifications, the Client agrees to be bound by the updated Terms.
